Abstract: The article explores the issues concerning the consequences in arbitration agreements for an insolvent party. Therefore, the authors analyze the New York Convention, beginning with Article II’s general deferral to arbitration agreements, followed by an analysis of the various grounds for refusing to recognize or enforce arbitral awards that are embodied in Article V.
